1. Acceptance of these terms
These Terms of Service ("Terms") form a contract between you and Kadir Alan, a sole proprietor (şahıs şirketi) operating in Türkiye ("Thanxful," "we," "us"). They govern your use of the Thanxful iOS app and the thanxful.app website (together, the "Service").
By creating an account, signing in, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
If you use the Service on behalf of an organization, you confirm that you are authorized to bind that organization to these Terms.

3. Eligibility
You must be at least 13 years old to use the Service. If you are between 13 and the age of legal majority where you live, you may use the Service only with the involvement of a parent or legal guardian who agrees to these Terms on your behalf.
You represent that:
- You are at least 13 years old.
- You have the legal capacity to enter into a binding contract (or, if you lack capacity under local law, your parent or legal guardian consents on your behalf).
- You are not barred from receiving the Service under the laws of Türkiye or any other country that applies to you.
Under Turkish Civil Code (TMK) Art. 15, minors (persons under 18) generally lack the capacity to form binding contracts without their parent or legal guardian's consent. If you are under 18, you may use the Service only with that consent, and your parent or legal guardian will be jointly bound by these Terms.
The app's App Store age rating (4+) describes the content of the app — it does not override the contractual 13+ eligibility requirement above.
4. What the Service does
Thanxful is a gratitude journal. You can write short journal entries, add moods, track streaks, and — if you choose to turn it on — receive AI-generated reflections on what you've written (see §10).
Thanxful is not a medical device, not a therapy service, and not a substitute for professional mental-health, medical, or legal advice. Although the App Store category is "Health & Fitness," the Service is a consumer wellness tool. If you are in emotional distress or a crisis, please contact a licensed mental-health professional or your local emergency services.
5. Your account
You need a Thanxful account to save entries, sync across devices, and access premium features.
- You are responsible for keeping your login credentials confidential and for everything that happens under your account.
- You may hold one account per person. Automated account creation is not permitted.
- Tell us immediately at
hello@thanxful.appif you suspect unauthorized use of your account. - We may suspend or terminate your account under §14 if you materially violate these Terms.
You can delete your account at any time from Settings → Advanced → Delete Account, or by emailing hello@thanxful.app. Deletion is irreversible (see the Privacy Policy §9).
6. Your content
You own your journal entries. We don't claim any ownership over what you write.
To run the Service, we need a narrow license to your content. By saving an entry, you grant us a worldwide, non-exclusive, royalty-free license to:
- Store your entries on our infrastructure so you can read them again.
- Display them back to you in the app.
- Transmit them, only if you explicitly opt in to AI insights (§10), to our AI sub-processors (OpenAI and Google Gemini) solely so they can generate insights for you.
This license is limited to operating the Service for you. It ends when you delete the content or your account. We do not use your entries:
- To train any AI model (ours or anyone else's).
- For marketing.
- To profile you.
- For any purpose other than running the Service you asked for.
You are solely responsible for your content. Don't write anything you are not legally entitled to, and don't include information about another identifiable person without their consent.
7. Acceptable use
When you use the Service, you agree not to:
- Use the Service for any unlawful, fraudulent, or harmful purpose.
- Upload content that infringes someone else's rights (including copyright, trademark, privacy, publicity, or personality rights).
- Upload content that is illegal in Türkiye or the country in which you use the Service — for example, child sexual abuse material, hate speech, or content that incites violence.
- Harass, stalk, or harm others, including through the Service's sharing features.
- Reverse-engineer, decompile, disassemble, or attempt to extract the source code of the app, except to the extent that Turkish law or EU law expressly allows.
- Scrape, bulk-copy, or automate access to the Service.
- Interfere with or disrupt the Service, its infrastructure, or other users.
- Impersonate another person, misrepresent your age, or use someone else's account.
- Circumvent any rate limits, anti-abuse checks, or feature gates.
- Attempt to discover bugs or vulnerabilities for purposes other than good-faith security research (if you find a vulnerability, please email
hello@thanxful.app).
We may remove content, limit features, suspend, or terminate your account if you violate these rules (see §14).
8. Subscriptions, payments, and auto-renewal
The Service offers premium subscriptions through the Apple App Store.
8.1 Products

Pricing is shown in the app at the time of purchase, in your local currency where Apple supports it. We may offer a free trial or introductory price; the terms and length of any trial will be shown before you start it.
8.2 Billing
Payment is charged to your Apple ID account at the time of purchase and at each renewal. We never see your payment method or card details. Subscriptions are managed by Apple; billing records are handled by Apple (as the merchant of record) and by RevenueCat on our behalf.
8.3 Auto-renewal
Your subscription renews automatically at the end of each billing period unless you cancel it at least 24 hours before the renewal date, as required by Apple.
8.4 How to cancel
You can cancel at any time in:
- iOS: Settings → [your Apple ID] → Subscriptions → Thanxful → Cancel Subscription.
- Or directly in Thanxful: Settings → Subscription → Manage Subscription (opens the iOS Subscriptions screen).
Cancellation stops the next renewal. You keep premium access until the end of the current paid period. You can also use https://apps.apple.com/account/subscriptions.
8.5 Refunds
All refund requests are handled by Apple at https://reportaproblem.apple.com. We cannot issue refunds ourselves because we are not the merchant of record.
For Turkish consumers (Türk tüketiciler için): Under Turkish Consumer Protection Law No. 6502 (TKHK) Art. 48 and the Regulation on Distance Contracts, digital content that starts to be delivered immediately with the consumer's express consent — which is the case for a Thanxful premium subscription — is exempt from the 14-day right of withdrawal. By starting your subscription and using premium features, you consent to immediate performance and accept that the 14-day withdrawal period does not apply. You may still cancel future renewals at any time (see §8.4) and you retain all mandatory consumer rights that cannot be waived under Turkish law.
8.6 Price changes
If we change the subscription price, we will notify you through the Apple App Store and / or in the app before the change affects your next renewal. If you don't agree to the new price, you can cancel before the renewal date.
9. Free features, premium features, and changes
Some features are free; some require an active premium subscription. We may add, change, or remove features from time to time. We may also move features between tiers with reasonable notice. Where a change materially reduces what you already paid for within the current billing period, we will either preserve your access for that period or issue a prorated refund through Apple.
10. AI insights
AI insights are optional. You must explicitly opt in before we send any of your journal content to an AI provider. You can turn AI insights off at any time in Settings → AI Consent.
- See Privacy Policy §6 for exactly what is sent, to whom, and how long they keep it.
- AI insights are generated by third-party models (OpenAI
gpt-4o-miniandgpt-4o, with Google Gemini as a fallback). The output is machine-generated text. It may be inaccurate, out of context, or simply wrong. - AI insights are not medical, legal, or therapeutic advice. Do not rely on them to make decisions about your health, safety, finances, or legal situation.
- We do not use your entries to train AI models.
11. Intellectual property
- Your content: you keep it. See §6.
- Our Service: we own, or license, everything that makes up Thanxful — the app code, user interface, design, logos, typefaces, theme packs (Espresso, Cosmos, etc.), animations, audio, prompt text, AI prompt templates, and all other materials — and we reserve all rights not expressly granted to you in these Terms.
- Your license to use the app: subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the app on iOS devices you own or control, for your personal, non-commercial use. This license automatically ends if you violate these Terms, if you stop using the Service, or if your account is terminated.
- Feedback: if you send us feedback, feature requests, or bug reports, you grant us a perpetual, worldwide, royalty-free license to use that feedback to improve the Service, without owing you anything. You're never obligated to send feedback.
12. Third-party services
The Service relies on third-party services — including Apple (App Store, Sign in with Apple, push notifications, DeviceCheck), Google (Firebase, Gemini), OpenAI, and RevenueCat — as described in the Privacy Policy §7. Your use of those third-party services is subject to their terms and policies, not ours. We are not responsible for third-party services.
13. Open-source notices
Thanxful includes open-source components, including:
- Firebase Apple SDK — Apache License 2.0.
- RevenueCat SDK — MIT License.
- Lottie (airbnb) — Apache License 2.0.
Attributions and full licenses are available in-app at Settings → About → Open-Source Licenses.
14. Suspension and termination
By you: you may stop using the Service and delete your account at any time (§5). Deletion removes your content from our active systems immediately and from backups and logs within 30 days (see Privacy Policy §9).
By us: we may suspend or terminate your access, with or without notice, if:
- You materially breach these Terms (for example, §7 Acceptable Use).
- We are required to do so by law or by a competent authority.
- Continued provision of the Service to you would expose us or other users to serious legal, security, or operational risk.
Where the law allows, we will give you advance notice and a reasonable chance to cure your breach. Sections that by their nature should survive (including §§6, 11, 15, 16, 17, 18) survive termination.
15. Disclaimers
The Service is provided "as is" and "as available." To the maximum extent permitted by applicable law:
- We do not warrant that the Service will be uninterrupted, error-free, secure, or that it will meet your expectations.
- We do not warrant that AI insights will be accurate, helpful, or fit for any particular purpose.
- We are not liable for content you or other users upload or share.
- We disclaim all implied warranties (including merchantability, fitness for a particular purpose, and non-infringement) to the extent the law lets us disclaim them.
Nothing in this section excludes warranties or rights that applicable law says cannot be excluded. If you are a consumer under Turkish Consumer Protection Law No. 6502, EU consumer law, UK consumer law, or a similar regime, you keep all the mandatory consumer rights that apply to you regardless of what this Agreement says.
16. Limitation of liability
To the maximum extent permitted by applicable law:
- Neither party is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or lost goodwill, arising out of or in connection with the Service, even if advised of the possibility.
- Our total cumulative liability to you for all claims arising out of or relating to these Terms or the Service is capped at the greater of (a) the amount you paid us (via Apple) for the Service in the 12 months preceding the event giving rise to the claim, or (b) USD 100.
These limits do not apply to, and we accept unlimited liability for:
- Our willful misconduct (kasıt) or gross negligence (ağır kusur / ağır ihmal) — whether it results in physical injury, data loss, privacy breach, or any other harm. Turkish Code of Obligations (TBK) Art. 115 makes any clause attempting to exclude liability for gross negligence or willful misconduct absolutely void; this carve-out reflects that rule.
- Fraud or fraudulent misrepresentation.
- Death or personal injury caused by our negligence.
- Liability that cannot be limited or excluded under applicable law, including mandatory consumer rights in Türkiye (Consumer Protection Law No. 6502), the EU, the UK, or your country of residence, and obligations arising from a personal-data breach under KVKK or GDPR.
17. Indemnity
To the extent permitted by applicable law, you agree to indemnify and hold harmless Kadir Alan and its officers, employees, and contractors against any third-party claim, liability, loss, or expense (including reasonable legal fees) arising out of:
- Content you upload that violates §7 (Acceptable Use) or that infringes a third party's rights, or
- Your willful or grossly negligent breach of these Terms.
This obligation does not apply to claims caused by our own negligence or willful misconduct, and it does not apply at all if you are using the Service as a consumer (as defined under Turkish Consumer Protection Law No. 6502, EU consumer law, or equivalent regimes) — consumer-protection rules in your jurisdiction override this clause to the extent they conflict.
18. Governing law and dispute resolution
Governing law: these Terms and any dispute arising out of them are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods does not apply.
Venue: the courts and enforcement offices of İzmir, Türkiye (İzmir Mahkemeleri ve İcra Daireleri) have non-exclusive jurisdiction over disputes arising out of these Terms. İzmir is our habitual place of business as a sole proprietor (şahıs şirketi), which makes it the default venue under Article 6 of the Turkish Civil Procedure Code (HMK).
Mandatory mediation for high-value consumer disputes (dava şartı arabuluculuk): under Article 73/A of Turkish Consumer Protection Law No. 6502 and Law No. 6325 on Mediation in Civil Disputes, consumer disputes above the Consumer Arbitration Board monetary threshold (as of 2026: ₺186,000) must first be submitted to a licensed mediator before a consumer-court lawsuit can be filed. Consumer disputes at or below that threshold are handled by the local Tüketici Hakem Heyeti (Consumer Arbitration Board) and do not require mediation.
Consumer rights preserved: if you are a consumer, nothing in this section removes your right to bring an action in the courts of your own habitual residence under Article 73(5) of Turkish Consumer Protection Law No. 6502, or under equivalent mandatory local consumer law where you live. Türkiye-resident consumers may contact their local Tüketici Hakem Heyeti under Law No. 6502.
19. Apple-specific terms
These Terms are between you and Kadir Alan, not with Apple Inc. Apple is not responsible for the Service or its content. However, as required by the Apple App Store:
- Scope of license. The license granted in §11 is limited to use on an Apple-branded product that runs iOS and is owned or controlled by you, and as permitted by the Apple Media Services Terms ("Apple EULA"). The Apple EULA applies to your use of the app; if these Terms conflict with the Apple EULA on licensing scope, the more restrictive terms apply.
- Maintenance and support. We, not Apple, are solely responsible for providing any maintenance or support.
- Warranty. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the app. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
- Product claims. We, not Apple, are responsible for addressing claims by you or a third party relating to the app, including product-liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims under consumer-protection, privacy, or similar legislation.
- Intellectual-property claims. If a third party claims that the app or your use of it infringes their intellectual-property rights, we (not Apple) are solely responsible for the investigation, defense, settlement, and discharge of that claim.
- Third-party beneficiary. You acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- Compliance. You represent that (a) you are not in a country subject to a U.S. government embargo or designated as a "terrorist-supporting" country, and (b) you are not on any U.S. government list of prohibited or restricted parties.
20. Changes to these Terms
We may update these Terms from time to time. For material changes, we will give you at least 30 days' notice by email and an in-app banner before the change takes effect. For non-material changes (typo fixes, clarifications), we will update the document and bump the "Effective Date" at the top.
If you don't agree with a change, stop using the Service and delete your account before the new Terms take effect. Continued use after the effective date means you accept the updated Terms.
21. General
- Entire agreement. These Terms, the Privacy Policy, and any additional policies we post form the entire agreement between you and us about the Service.
- No waiver. If we don't enforce a right, that's not a waiver of that right.
- Severability. If any provision is held unenforceable, the rest remain in effect, and the unenforceable provision will be replaced with an enforceable one that best reflects the original intent.
- Assignment. You may not assign these Terms without our written consent. We may assign them to an affiliate or to a successor in connection with a merger, acquisition, or sale of all or substantially all of our assets, on notice to you.
- No agency. No partnership, agency, or employment relationship is created by these Terms.
- Force majeure. Neither party is liable for failure to perform due to events beyond its reasonable control (e.g., natural disaster, internet outage, government action, labor disruption).
- Language. The authoritative version of these Terms is the Turkish (Türkçe) text, available at
https://thanxful.app/tr/terms-of-serviceand in this repository asterms-of-service.tr.md. Translations into English and other languages are provided for convenience only. In the event of any discrepancy, the Turkish text prevails, in line with Law No. 805 on the Compulsory Use of Turkish in Economic Enterprises (10 April 1926). - Notices. We may send you notices to the email on your account, through the app, or by posting on
